NOTICE OF INTERIM RESTRAINING ORDER

On 10 October 2007, the Takeovers Panel gave notice under section 32(1) of the Takeovers Act 1993,† that it would hold a meeting for the purpose of determining whether to exercise its powers under that section in relation to the actions of a number of shareholders of Kerifresh Limited since July 2001 involving the acquisition of shares by various parties including Kerifresh Limited itself.
NOTICE IS HEREBY GIVEN THAT the Takeovers Panel has made an order under sections 32(2) and 33(a), (b) and (c) of the Takeovers Act 1993†:
- Restraining PHILIP HAMISH MCHARDY, AUDREY ANN MCHARDY, and SUNDRY INVESTMENTS LIMITED from acquiring or disposing of securities in Kerifresh or any interest in or rights relating to Kerifresh securities; and
- Restraining PHILIP HAMISH MCHARDY, AUDREY ANN MCHARDY, and SUNDRY INVESTMENTS LIMITED from exercising the right to vote attaching to securities in Kerifresh or any other right relating to Kerifresh securities.
This order expires at the close of 18 October 2007.
